Does your company need verification that your exports are freely marketed without restriction and approved for sale in the United States and Montana?

 

The Montana World Trade Center can issue you a Certificate of Free Sale, evidence that a product was manufactured in, packaged, or distributed from the state of Montana freely without restriction.

If the U.S. Food and Drug Administration (FDA) covers your product, we cannot issue a Certificate of Free Sale for you. You must contact the FDA directly and have them issue the certificate.

Why do I need a Certificate of Free Sale?

 

Many countries now require a Certificate of Free Sale. These are sometimes also referred to as a “Certificate of Export” or “Certificate to Foreign Governments”. They are an assurance to a foreign agency that the products listed on the certificate are freely sold and manufactured in the United States.

What is an Apostille? And why would I need one?

An Apostille is simply the name for a specialized certificate, issued by the Secretary of State. The Apostille is attached to your original document to verify it is legitimate and authentic so it will be accepted in one of the other countries who are members of the Hague Apostille Convention.

You will need the required documentation outlined below.

READ CAREFULLY – Certificates may be delayed, denied, and include additional costs if the requirements below are not met.

STEP 1: Please specify for which country or list of countries you would like the Certificate(s) issued (not just regions).

STEP 2: You must provide a Manufacturer’s Declaration in which you declare where your products are manufactured and that they are freely sold within the United States. The declaration must:

    • 1. Be printed on the manufacturer’s letterhead, and signed by the manufacturer;
    • 2. Contain within the declaration the names of the products being certified;
    • 3. Include the language “products are manufactured in (insert country here) and freely sold in the USA,” and
    • 4. Include the name of the applicant company if different from the manufacturer.

STEP 3: For each product listed on the Certificate of Free Sale, your company must submit copies of invoices showing sales to two different U.S. customers.

STEP 4: The invoices must be dated within the last 12 months. The product names must be the same as how they will appear on the Certificate.

STEP 5: Provide a list of products you wish to include on the Certificate(s)*. Product names must match invoice documentation by at least 80%. For example, a product is named ‘Grape Beauty Bar’ on the invoice but can be listed as ‘Moisturizing Grape Beauty Bar’ on the certificate. If the product name listed on the form does not match the name on the invoice, we will not be able to process the certificate. If necessary, provide a separate product key that compares names between the declaration and invoice.

STEP 6: List your company name and address. The name and address need to match the name and address on the invoices documentation.

*All fees must be paid in advance and are non-refundable. Each certificate covers the first 100 products, orders exceeding this amount will be charged $25 for each additional certificate.

**Please include an account number and method of shipment if your certificate needs to be returned via FedEx, UPS or USPS. Please allow 7 business days for certificates to be processed and returned by mail.
